3. EMPLOYEE REGISTERED ON SHIROMANI INSTITUTE AGREE THAT THEY WILL NOTIFY SHIROMANI INSTITUTE OF ANY CONTRACT THAT THEY SIGN WITH A INSTITUTE, REGARDLESS OF WHETHER THEY HAVE SECURED THE POSITION THROUGH SHIROMANI INSTITUTE OR NOT.
5. EMPLOYEE WHOSE PROFILES ARE SET TO ‘GREEN’ RECOGNISE THAT THEIR PROFILES ARE VISIBLE TO INSTITUTE RECRUITERS. THESE MAY INCLUDE RECRUITERS FROM THE INSTITUTE A EMPLOYEE IS CURRENTLY EMPLOYED BY. INSTITUTE RECRUITERS MAY ACCESS ANY ‘GREEN’ EMPLOYEE’S PROFILE INFORMATION (INCLUDING THEIR CVS, SUPPORTING DOCUMENTS AND REFERENCES). IT IS A EMPLOYEE’S RESPONSIBILITY TO SWITCH THEIR PROFILE TO ‘YELLOW’ OR ‘RED’ IF THEY DO NOT WISH FOR THEIR PROFILE TO BE VISIBLE. SHIROMANIINSTITUTE WILL NOT BE HELD RESPONSIBLE FOR ISSUES ARISING AROUND CANDIDATE PROFILE SETTINGS AND WILL SWITCH A CANDIDATE’S PROFILE TO ‘RED’ IF A CANDIDATE IS INACTIVE ON SHIROMANI INSTITUTE WEBSITE FOR MORE THAN TWO MONTHS.

SHOULD A EMPLOYEE RECEIVE AN OFFER OF EMPLOYMENT (VERBAL, WRITTEN OR EMAILED) THROUGH USING ANY OF SHIROMANI INSTITUTE SERVICES AND ACCEPT, THEN THEIR COMMITMENT IS BINDING AND SUBJECT TO THE EMPLOYMENT AGREEMENT BETWEEN THE EMPLOYEE AND THE RELEVANT INSTITUTE. BELOW WE SET OUT SOME (BUT NOT ALL) OF THE TERMS WHICH ARE INDICATIVE OF AN AGREEMENT TO BE REACHED BETWEEN A EMPLOYEE AND A INSTITUTE.
(6A) SHOULD A EMPLOYEE ACCEPT A POSITION AND THEN RENEGE ON THE CONTRACT (OR AGREEMENT), THE EMPLOYEE WILL BE RESPONSIBLE FOR COVERING PART OF THE COST OF FINDING A REPLACEMENT CANDIDATE.
(6B) SHOULD A EMPLOYEE LEAVE A INSTITUTE BEFORE COMPLETING THEIR CONTRACT, THE EMPLOYEE MAY ALSO BE LIABLE FOR THE COSTS OF FINDING A REPLACEMENT EMPLOYEE. THIS DEPENDS ON THE CONTRACT THE EMPLOYEE HAS WITH THE INSTITUTE.
(6C) SHOULD A EMPLOYEE FAIL TO FOLLOW THE APPLICATION INSTRUCTIONS AND APPLY DIRECTLY TO A INSTITUTE FOR A ‘SUPPORTED’ POSITION, THE EMPLOYEE MAY BE EXPECTED TO PAY A PENALTY FEE.
(6D) SHOULD A EMPLOYEE DO ANY OF THE ABOVE (CLAUSE 6), SHIROMANI INSTITUTE RESERVES THE RIGHT TO NO LONGER WORK WITH THAT EMPLOYEE, TO DELETE HIS/HER PROFILE AND TO REMOVE HIS/HER ACCESS TO THE SHIROMANI INSTITUTE PLATFORM.
7. EMPLOYEE USING SHIROMANI INSTITUTE MUST NEVER HAVE BEEN KNOWN TO ANY CHILDREN’S SERVICES DEPARTMENT OR POLICE AS BEING A RISK OR POTENTIAL RISK TO CHILDREN. EQUALLY, THEY SHOULD NEVER HAVE BEEN THE SUBJECT OF ANY DISCIPLINARY INVESTIGATION AND/OR SANCTION BY ANY ORGANISATION IN RELATION TO CONCERNS ABOUT THEIR BEHAVIOUR TOWARDS CHILDREN.

USE OF COMPANY RESOURCES FOR PERSONAL USE IS STRICTLY RESTRICTED. HIS INCLUDES USAGE OF COMPUTER RESOURCES, INFORMATION, INTERNET SERVICE, AND WORKING TIME OF THE COMPANY FOR ANY PERSONAL USE.
I. EITHER PARTY CAN TERMINATE THIS EMPLOYMENT BY SERVING A NOTICE OF ONE MONTH ON THE OTHER, SAVE AND ACCEPT THAT THE COMPANY MAY AT ITS OPTION PAY SALARY IN LIEU OF THE NOTICE PERIOD TO TERMINATE EMPLOYMENT WITH IMMEDIATE EFFECT.
II. UNAUTHORIZED ABSENCE OR ABSENCE WITHOUT PERMISSION FROM DUTY FOR A CONTINUOUS PERIOD OF 7 DAYS WOULD MAKE YOU LOSE YOUR LIEN ON EMPLOYMENT. IN SUCH CASE YOUR EMPLOYMENT SHALL AUTOMATICALLY COME TO AN END WITHOUT ANY NOTICE OF TERMINATION OR NOTICE PAY.
III. YOU WILL BE GOVERNED BY THE LAID DOWN CODE OF CONDUCT OF THE COMPANY AND IF THERE IS ANY BREACH OF THE SAME OR NON CONFORMANCE OF CONTRACTUAL OBLIGATION OR WITH THE TERMS AND CONDITIONS LAID DOWN IN THIS AGREEMENT, YOUR SERVICE CAN BE TERMINATED WITHOUT ANY NOTICE; NOTWITHSTANDING ANY OTHER TERMS AND CONDITIONS STIPULATED HEREIN THE COMPANY RESERVES THE RIGHT TO INVOKE OTHER LEGAL REMEDIES AS IT DEEMS FIT TO PROTECT ITS LEGITIMATE INTEREST.
VI. IN CASE OF MISBEHAVIOR, INDISCIPLINE AND ILLEGAL ACTIVITY BY ANY EMPLOYEE, COMPANY HAS TO RIGHT IMMEDIATELY TERMINATE HIS EMPLOYMENT WITHOUT ANY NOTICE OF TERMINATION OR NOTICE PAY AND NO EXPERIENCE LETTER WILL ISSUED BY COMPANY.
IT MUST BE SPECIFICALLY UNDERSTOOD THAT THIS OFFER IS MADE BASED ON YOUR PROFICIENCY ON TECHNICAL/PROFESSIONAL SKILLS YOU HAVE DECLARED TO POSSESS AS PER YOUR APPLICATION FOR EMPLOYMENT AND YOUR ABILITY TO HANDLE ANY ASSIGNMENT/JOB INDEPENDENTLY. IN CASE AT A LATER DATE ANY OF YOUR STATEMENTS/PARTICULARS FURNISHED ARE FOUND TO BE FALSE OR MISLEADING OR YOUR PERFORMANCE IS NOT UP TO THE MARK OR FALLS SHORT OF THE MINIMUM STANDARD SET BY THE COMPANY, THE COMPANY SHALL HAVE THE RIGHT TO TERMINATE YOUR SERVICES FORTHWITH WITHOUT GIVING ANY NOTICE NOTWITHSTANDING ANY OTHER TERMS AND CONDITIONS STIPULATED THEREIN.
THE ABOVE TERMS AND CONDITIONS ARE BASED ON THE COMPANY’S POLICY, PROCEDURES AND OTHER RULES CURRENTLY APPLICABLE IN INDIA AND ARE SUBJECT TO AMENDMENTS AND ADJUSTMENTS FROM TIME TO TIME. IN ALL MATTER INCLUDING THOSE NOT SPECIFICALLY COVERED HERE SUCH AS TRAVELING, RETIREMENT, ETC. YOU WILL BE GOVERNED BY THE RULES OF THE COMPANY AS SHALL BE IN FORCE FROM TIME TO TIME.
